Terms of Service: Meal Whisperer

PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY. These Terms form a binding legal contract between you ("you," "your," or "User") and Meal Whisperer LLC, a California limited liability company ("Meal Whisperer," "we," "us," or "our"). These Terms govern your access to and use of the Meal Whisperer website, mobile applications, application programming interfaces, and related products, features, content, and services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, CREATING AN ACCOUNT, OR CLICKING A BUTTON OR CHECKING A BOX INDICATING ACCEPTANCE, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.

THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 20. PLEASE REVIEW CAREFULLY, AS THEY AFFECT YOUR LEGAL RIGHTS.

1. Eligibility; Minors and Family Use

To create an account, you must be at least 13 years of age. Meal Whisperer is designed for individuals and households, and we know that cooking is something families do together.

Users under 18. If you are under 18 years of age (or the age of legal majority in your jurisdiction, if higher), you may use the Service only with the involvement, supervision, and consent of a parent or legal guardian who is at least 18, who has read and agreed to these Terms, and who agrees to be bound by them on your behalf. By using the Service while under 18, you represent that you have obtained such consent. A parent or legal guardian who consents to a minor's use is responsible for: (a) all use of the Service by that minor; (b) all User Content the minor submits; (c) all purchases, subscriptions, and other transactions initiated through the minor's use; and (d) supervising the minor's use and ensuring that the content, recipes, and features they access are appropriate for the minor's age, maturity, allergies, and dietary needs.

Children under 13. The Service is not intended for children under the age of 13. We do not knowingly allow children under 13 to create accounts, and we do not knowingly collect personal information from children under 13.

Family use. The account holder may allow other members of their household to use the Service under the account holder's supervision. The account holder remains responsible for all use of the Service through their account, including all User Content, purchases, and other transactions, and for ensuring that any information entered about another household member (including a minor) is provided in compliance with applicable law and, where the member is a minor, with appropriate parental consent.

If you are a parent or guardian and believe a child under 13 has created an account in violation of these Terms or has provided personal information to us, please contact privacy@mealwhisperer.com so we can investigate and, if appropriate, delete the information and terminate the account.

2. Accounts and Registration

To access certain features, you must create an account. You agree to: (a) provide accurate, current, and complete information; (b) maintain and promptly update your information; (c) maintain the confidentiality of your credentials; (d) not share your account with anyone; and (e) be responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials. You must notify us immediately of any unauthorized use of your account at security@mealwhisperer.com. We may suspend or terminate accounts that contain inaccurate or fraudulent information.

3. Description of the Service

Meal Whisperer is a software platform that uses artificial intelligence, machine learning, and curated content to provide personalized meal suggestions, recipe ideas, nutritional information, grocery lists, dietary planning tools, and related features. The features, functionality, and availability of the Service may change at any time, with or without notice. We may add, remove, modify, or impose limits on features at our discretion, and we may discontinue the Service or any part of it at any time.

4. License to Use the Service

Subject to your compliance with these Terms, Meal Whisperer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved. This license does not include any right to: (a) resell, distribute, or commercially exploit the Service or any content within it; (b) use any data mining, robots, scraping, or similar data gathering or extraction methods; (c) use the Service to develop a competing product or service; (d) reverse engineer, decompile, or disassemble any portion of the Service; or (e) use the Service or any of its outputs to train, fine-tune, or improve any machine learning model or artificial intelligence system without our prior express written consent.

5. AI-Generated Output; No Reliance

The Service uses artificial intelligence and machine learning models, including third-party large language models, to generate recipes, meal plans, nutritional estimates, ingredient substitutions, allergen and dietary flags, and other content ("AI Output"). AI Output is generated probabilistically and may be inaccurate, incomplete, biased, outdated, offensive, or misleading. AI Output may not reflect current scientific consensus, may contain factual errors (including errors in nutritional values, cooking times, food safety guidance, allergen identification, ingredient interactions, brand or product identification, or measurement conversions), and should not be relied upon as the sole basis for any decision.

Automated flagging is best-effort. The Service may attempt to automatically flag allergens, dietary restrictions, or other concerns in recipes or other content. This flagging is automated, best-effort, and not a guarantee. The Service may fail to flag a relevant ingredient, may incorrectly flag an ingredient that is not present, or may misidentify a brand, product, or substitute. You must not rely on flagging as your sole means of identifying ingredients, allergens, or restrictions.

Quantitative estimates. Any quantitative figures generated, displayed, or communicated by the Service or in our marketing materials — including calorie counts, macronutrient breakdowns, micronutrient values, portion sizes, cooking times, cost estimates, savings estimates, and time-saved estimates — are approximations based on third-party data sources, statistical averages, or AI-generated estimates. They are not guarantees, and your actual results will vary based on your circumstances, behavior, household, location, and many other factors.

YOU ARE SOLELY RESPONSIBLE FOR EVALUATING THE ACCURACY, COMPLETENESS, AND USEFULNESS OF AI OUTPUT AND FOR ANY DECISIONS YOU MAKE OR ACTIONS YOU TAKE BASED ON IT. DO NOT RELY ON AI OUTPUT FOR ANY DECISION THAT MAY AFFECT YOUR HEALTH, SAFETY, OR WELL-BEING. YOU UNDERSTAND THAT AI OUTPUT MAY DESCRIBE OR RECOMMEND INGREDIENTS, PREPARATION METHODS, OR FOOD COMBINATIONS THAT ARE UNSAFE, UNHEALTHY, OR INCOMPATIBLE WITH YOUR PERSONAL CIRCUMSTANCES (INCLUDING ALLERGIES, INTOLERANCES, MEDICAL CONDITIONS, MEDICATIONS, OR DIETARY RESTRICTIONS).

6. No Medical, Nutritional, or Professional Advice; Allergies and Food Safety

THE SERVICE IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL, NUTRITIONAL, DIETETIC, OR HEALTH ADVICE. MEAL WHISPERER IS NOT A HEALTHCARE PROVIDER.

You should consult a qualified physician, registered dietitian, or other licensed healthcare professional before making any significant change to your diet, beginning any meal plan, or relying on any information provided through the Service, particularly if you have allergies, food intolerances, chronic conditions (including diabetes, cardiovascular disease, kidney disease, eating disorders, or autoimmune disorders), are pregnant or nursing, are taking medications, or have any other circumstance that may interact with food choices.

ALLERGY AND DIETARY RESTRICTION WARNING: Meal Whisperer cannot guarantee that recipes, meal plans, or product recommendations are free from any specific allergen, contaminant, or ingredient. Nutritional information is an estimate and may be inaccurate. Cross-contamination is possible in any kitchen or supply chain.

YOU MUST ALWAYS READ PRODUCT LABELS AND VERIFY INGREDIENTS BEFORE CONSUMING ANY FOOD. If you have a food allergy, intolerance, religious dietary requirement, or medical dietary restriction, you must independently verify the safety and contents of every ingredient and product before consumption — every time, including when you have used a product before, because manufacturers can and do change ingredients and formulations. Contact manufacturers directly if uncertain. Do not rely solely on any information provided by the Service.

Brand and product references. The Service may identify, mention, or reference specific brands, products, or retailers. Any such reference is informational only. We do not endorse, certify, or independently verify the safety, availability, ingredients, formulation, or suitability of any brand or product, and product specifications can change without notice.

User-imported recipes and content. You may bring recipes, ingredient lists, screenshots, links, or other content from external sources into the Service. You are responsible for the accuracy and lawfulness of any content you import, and for verifying that any ingredients, instructions, and brand references in imported content are appropriate for your circumstances.

FOOD SAFETY WARNING: Improper food handling, storage, or preparation can cause serious illness or death. The Service does not replace standard food safety practices. You are solely responsible for proper sanitation, cooking temperatures, storage, and handling. If you experience any adverse reaction or believe you have ingested an unsafe food, seek immediate medical attention.

7. User Content and Licenses

7.1 Your Content

The Service may allow you to submit, post, upload, link, or otherwise make available content, including photos, recipes, reviews, ratings, comments, ingredient lists, dietary preferences, custom meal plans, journal entries, and other materials ("User Content"). You retain ownership of your User Content.

7.2 License to Meal Whisperer

By submitting User Content, you grant Meal Whisperer a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, cache, reproduce, modify, adapt, and display your User Content as needed to: (a) operate, provide, secure, and improve the Service for you; (b) generate recipes and other features at your request, including by sending your inputs to the third-party AI providers described in our Privacy Policy; and (c) generate aggregated or de-identified data and insights. We handle your User Content in accordance with our Privacy Policy. If you choose to share User Content publicly or with other users, you grant the additional license needed for us to make it available as you direct.

7.3 Representations

You represent and warrant that: (a) you own all rights in your User Content or have obtained all necessary licenses and permissions; (b) your User Content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, or any law or contract; and (c) your User Content is accurate and not misleading.

7.4 No Obligation to Use; Right to Remove

We are not obligated to use, display, store, or retain your User Content, and we may remove or refuse to publish User Content at any time and for any reason, with or without notice.

8. Acceptable Use; Prohibited Conduct

You agree not to, and not to attempt to:

Violate any applicable law, regulation, or third-party right;
Upload, post, or transmit any content that is unlawful, defamatory, obscene, harassing, threatening, hateful, discriminatory, sexually explicit, exploitative of minors, or otherwise objectionable;
Impersonate any person or entity or misrepresent your affiliation with any person or entity;
Use the Service to send unsolicited communications, spam, chain letters, or pyramid schemes;
Upload viruses, malware, or other malicious code, or interfere with or disrupt the Service or its servers, networks, or security;
Attempt to gain unauthorized access to the Service, other users' accounts, or any related systems;
Scrape, harvest, crawl, frame, or otherwise extract data from the Service, except via official APIs in accordance with their documentation;
Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying models, weights, or training data of the Service;
Use the Service or any AI Output to train, develop, or improve any machine learning model or artificial intelligence system without our prior express written consent;
Manipulate, mislead, or deceive the Service's AI models, including via prompt injection, jailbreaking, or adversarial inputs;
Use the Service for any purpose that is harmful to public health, including the promotion of disordered eating, unsafe food practices, or use of dangerous ingredients; or
Encourage or assist any third party to do any of the foregoing.

9. Subscriptions, Payments, and Auto-Renewal

9.1 Paid Plans

The Service requires a paid subscription ("Paid Plan"); there is no free tier. Subscriptions are sold and processed through the app store you downloaded the app from, and by purchasing you authorize that store to charge the applicable fees, taxes, and other charges to the payment method on file with your store account. We never receive or store your payment card details. Prices are shown in your store's local currency at the point of purchase and may be exclusive of taxes, which you are responsible for paying.

9.2 Auto-Renewal

UNLESS YOU CANCEL BEFORE THE END OF THE THEN-CURRENT BILLING PERIOD, YOUR PAID PLAN WILL AUTOMATICALLY RENEW FOR SUCCESSIVE BILLING PERIODS OF EQUAL LENGTH AT THE THEN-CURRENT RATE.

You may cancel auto-renewal at any time via your account settings or, for subscriptions purchased through a third-party app store, through the applicable store's subscription management interface. Cancellation will take effect at the end of the then-current billing period; you will retain access until that time. Notice of price changes will be provided in advance as required by applicable law.

9.3 Free Trials

We may offer a free trial of a Paid Plan. Unless you cancel at least 24 hours before the trial ends, the trial converts automatically into the applicable Paid Plan and your store account is charged the then-current fee. The length of the trial and the price that follows it are shown to you before you confirm the purchase. Eligibility for a free trial is determined by the app store, not by us — a store account that has already used a trial or introductory offer for a Meal Whisperer subscription will generally not be offered another one, and in that case the full price applies from the start. Certain features may be limited during a trial; any such limits are shown in the app.

9.4 Fees, Cancellation, and Refunds

(a) Cancellation. You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period: you keep full access until then, and you will not be charged again. Cancelling stops future charges; it does not refund fees you have already paid.

(b) Purchases through app stores. If you subscribed or bought an image pack through the Apple App Store or Google Play, your payment is processed by the store, and refunds are requested from and decided by the store under its policies, not by Meal Whisperer. To request a refund for an App Store purchase, use Apple's Report a Problem process; for Google Play, use the Play refund process. Meal Whisperer does not control the store's refund decisions.

(c) Purchases made directly from us. For subscriptions and image packs purchased on our website, fees already paid are non-refundable except where the law gives you a refund or withdrawal right. If you are a consumer in a jurisdiction with a statutory withdrawal right (for example, the EU or UK 14-day withdrawal period), you may withdraw within that period; where you asked us to start providing the Service right away, we may deduct a proportionate amount for the Service already provided, as permitted by that law.

(d) Your legal rights are not limited. Nothing in these Terms takes away or limits any refund, withdrawal, or other consumer right that the law of the place you live gives you and does not allow you to waive.

(e) Image packs and credits. Purchased image packs are delivered to your account immediately and never expire. Credits you have already spent cannot be returned or refunded. If a pack purchase is refunded, the unspent credits from that purchase are removed from your account. Packs bought through an app store follow Section 9.4(b); packs bought directly from us follow Section 9.4(c).

9.5 App Store Purchases

If you purchase a subscription or a credit pack through the Apple App Store, Google Play Store, or another third-party app store, your purchase is governed by that store's terms in addition to these Terms, and any cancellation or refund must be processed through that store.

9.6 Usage Allowances and Fair Use

Recipes, recipe changes, and meal plans are not metered, subject to the fair-use and acceptable-use limits in Section 8. Certain resource-intensive features are metered: in particular, AI-generated dish images are provided as a periodic allowance attached to your Paid Plan, and the size of that allowance, and the period it covers, are shown in the app and may differ between plans and during a free trial. Photos you take or upload yourself never count against any allowance. Reaching an allowance does not affect your access to your saved content, and we will not delete or withhold recipes you have already created because an allowance is exhausted. We may adjust allowances prospectively on reasonable notice as described in Section 15.

9.7 Credit Packs (Consumable Purchases)

We may offer one-time purchases of additional AI image credits ("Credit Packs"). Credit Packs are consumable digital items: they are added to your account on purchase, are consumed as you use them, and do not renew. Credits have no cash value, are not redeemable for money, cannot be transferred, sold, or exchanged, and are licensed rather than sold to you. Credits do not expire, but they are forfeited without compensation if your account is deleted or terminated under Section 14. A Credit Pack is a separate purchase from your subscription and is not required to use the Service. Delivery, consumption, and refunds of Credit Packs are governed by Section 9.4(e).

10. Third-Party Services and Links

The Service may contain links to, or let you import content from, third-party websites, applications, and services ("Third-Party Services") — for example, when you import a recipe from a link or screenshot you provide. We do not control, endorse, or assume responsibility for any Third-Party Services. Your use of Third-Party Services is at your own risk and is governed by their own terms and privacy policies. Information provided by a Third-Party Service (such as a website you import a recipe from) may be inaccurate or out of date.

11. Intellectual Property

The Service, including all software, text, graphics, images, audio, video, recipes (other than User Content), interfaces, designs, AI models, model weights, trademarks, logos, and the selection, arrangement, and "look and feel" of the foregoing (collectively, "Meal Whisperer IP"), is owned by Meal Whisperer or its licensors and is protected by U.S. and international intellectual property and other laws. Except for the limited license expressly granted in Section 4, no rights in the Meal Whisperer IP are granted to you. "Meal Whisperer" and our logos are trademarks of Meal Whisperer, LLC; all other marks are the property of their respective owners.

12. Feedback

If you submit suggestions, ideas, enhancement requests, recommendations, or other feedback regarding the Service ("Feedback"), you hereby grant Meal Whisperer a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, exploit, and incorporate the Feedback for any purpose, without compensation or attribution.

13. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a notice to our designated agent that complies with 17 U.S.C. § 512(c)(3). Send notices to: copyright@mealwhisperer.com. We may terminate accounts of repeat infringers.

14. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice and with or without cause, including if we believe you have violated these Terms, posed a risk to the Service or other users, exposed us to legal liability, or have an account that has been inactive for an extended period. You may terminate your account at any time by following the instructions in the Service or by contacting support@mealwhisperer.com. Upon termination, your right to use the Service will cease immediately, and we may delete your data in accordance with our Privacy Policy and applicable law.

15. Changes to the Service and These Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide notice through the Service, by email, or by other reasonable means. The updated Terms will be effective as of the date posted (or as otherwise stated in the notice). If you do not agree to the updated Terms, you must stop using the Service. Your continued use after the effective date constitutes acceptance.

16. Disclaimers of Warranties

THE SERVICE AND ALL CONTENT, INCLUDING AI OUTPUT, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MEAL WHISPERER, ITS AFFILIATES, AND ITS LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, MEAL WHISPERER MAKES NO WARRANTY THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS; (B) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR APPROPRIATE FOR YOUR HEALTH, DIETARY, OR OTHER CIRCUMSTANCES; (C) ANY AI OUTPUT IS ACCURATE, COMPLETE, SAFE, NUTRITIOUS, OR ALLERGEN-FREE; OR (D) DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, some of the above exclusions may not apply to you.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MEAL WHISPERER, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL MEAL WHISPERER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MEAL WHISPERER FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

The limitations in this Section apply to the maximum extent permitted by law and even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow the limitation or exclusion of certain damages; in such jurisdictions, some of the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Meal Whisperer, its affiliates, and their respective officers, directors, employees, agents, suppliers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of a third party.

19. Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE AND ANY DIET, RECIPE, MEAL, INGREDIENT, OR OTHER CONTENT OBTAINED THROUGH THE SERVICE IS AT YOUR OWN RISK. YOU ASSUME ALL RISKS ASSOCIATED WITH PREPARING, CONSUMING, OR ACTING UPON ANY CONTENT FROM THE SERVICE, INCLUDING ALLERGIC REACTIONS, FOODBORNE ILLNESS, INJURY, AND ANY OTHER ADVERSE EFFECT.

20. Binding Arbitration; Class Action Waiver

Please read this Section carefully. It affects your legal rights, including your right to file a lawsuit in court.

20.1 Informal Resolution

Before initiating arbitration, you and Meal Whisperer agree to attempt to resolve any dispute informally for at least 60 days. To start, send a written notice describing the dispute to legal@mealwhisperer.com and to Meal Whisperer's registered agent.

20.2 Agreement to Arbitrate

YOU AND MEAL WHISPERER AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, OR THE RELATIONSHIP BETWEEN US ("DISPUTE") THAT IS NOT RESOLVED INFORMALLY WILL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, except that you and Meal Whisperer may bring an individual action in small claims court or seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

20.3 Rules and Forum

The arbitration will be administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures. The arbitration will take place in San Diego, California, unless you and Meal Whisperer agree otherwise or applicable law requires another location. The Federal Arbitration Act governs the interpretation and enforcement of this Section.

20.4 Class Action Waiver

YOU AND MEAL WHISPERER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

20.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@mealwhisperer.com within 30 days after first accepting these Terms.

20.6 Jury Trial Waiver

EXCEPT AS OTHERWISE PROHIBITED BY LAW, YOU AND MEAL WHISPERER EACH WAIVE ANY RIGHT TO A JURY TRIAL.

21. Governing Law and Venue

These Terms and any Dispute are governed by the laws of the State of California, without regard to its conflict of laws principles. To the extent that any Dispute is not subject to arbitration under Section 20, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in San Diego County, California.

22. Time Limitation on Claims

Any claim or cause of action arising out of or relating to these Terms or the Service must be filed within one (1) year after such claim or cause of action arose; otherwise, it is permanently barred, except where prohibited by applicable law.

23. General Provisions

These Terms, together with the Privacy Policy and any other policies or terms referenced herein, constitute the entire agreement between you and Meal Whisperer regarding the Service and supersede all prior agreements. Our failure to enforce any provision is not a waiver of that provision. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. You may not assign these Terms without our prior written consent. We may freely assign these Terms, including in connection with a merger, acquisition, or sale of assets.

Export compliance and sanctions. The Service may be subject to United States export control and economic sanctions laws. By using the Service, you represent and warrant that you are not located in, and are not a national or resident of, any country or territory subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited, denied, or restricted parties. You agree not to use or export the Service in violation of any applicable export control or sanctions law.

24. Mobile Application Stores

Apple App Store. If you download the Service from the Apple App Store, you acknowledge and agree that: (a) these Terms are between you and Meal Whisperer, not Apple, and Apple is not responsible for the Service or its content; (b) the license granted is limited to use on Apple-branded products you own or control; (c) Apple has no obligation to provide maintenance or support; (d) if the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application to you, and to the maximum extent permitted by applicable law Apple has no other warranty obligation with respect to the Service; (e) Apple is not responsible for addressing any claims relating to the Service, including product liability claims, any claim that the Service fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation; and (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play. If you download the Service from Google Play, you acknowledge that your use is also governed by the Google Play Terms of Service and that Google is not a party to these Terms or responsible for the Service.

The sections below apply specifically to mealwhisperer.com and to the launch list. They sit alongside the terms above, which govern the Service as a whole.

The launch list

If you give us your email, you're asking us to contact you about Meal Whisperer. You can leave the list any time using the unsubscribe link in any message we send, or by emailing hello@mealwhisperer.com. Please only sign up with an email address you control.

We handle your email as described in our Privacy Policy.

The early-member discount

We intend to offer everyone on the launch list 50% off their first paid subscription term when Meal Whisperer becomes available. Some honest fine print:

The discount applies once, to your first paid term, and can't be combined with other offers.
We'll send the code to the email address you signed up with.
Pricing, plans, and launch timing aren't final and may change.
The offer isn't transferable and has no cash value.
If we can't launch, or we have to change the offer, we'll tell the list.

Fair use of the site

Don't try to break the site, get into parts of it that aren't public, submit other people's email addresses, or use automated tools to flood the signup form.
